Abstract

The Organic Law of Transparency and Access to the Ecuadorian Public Information is an existing but outdated, resulting standard of development of the Ecuadorian constitutional law on access to public information, which was mainly enshrined in article 81 of the repealed Constitution of this country. This LOTAIP was based on its historical moment in the freedom of information recognized both in article 19 of the International Covenant on Civil and Political Rights, and article 13 of the American Convention on Human Rights; which it is relevant when interpret and apply, since the right of access to public information has been developed by these broader than in the Ecuadorian Constitution international treaties form.
